These Terms and Conditions (“Terms”) govern your use of the quiz platform (“the Service”) operated by Mysa Digital (“we”, “us”, “our”). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, you must not use the Service.

1. Purpose of the Service

The Service is provided for educational purposes, including use in classrooms, training, or similar learning environments.

2. Eligibility

The Service may only be used by quiz creators who are aged 18 or over.
Participants in quizzes may be under 18 where appropriate in an educational setting, but responsibility for compliance with safeguarding and data protection laws rests with the quiz creator.

3. Data and Privacy

We do not store personal data of quiz participants beyond what is necessary to deliver quiz results by email to the user.
Email details are used solely to provide quiz results and are not retained by us once results are sent.
No participant data is shared, sold, or otherwise processed by us.
Our handling of information complies with the UK GDPR and the Data Protection Act 2018.

4. Responsibilities of Quiz Creators

You are solely responsible for the content of any quizzes you create, including ensuring that the material is accurate, lawful, and appropriate for your audience.
You must ensure that your use of the Service complies with all applicable laws, institutional policies, and ethical standards.
You must not upload, share, or use material that infringes intellectual property rights, is defamatory, discriminatory, obscene, or otherwise unlawful.

5. Intellectual Property

All intellectual property rights in the Service (including software, branding, and design) are owned by or licensed to Mysa Digital.
You retain intellectual property rights in the quiz content you create. By uploading such content, you grant us a non-exclusive licence to host and deliver it through the Service.

6. Acceptable Use

You agree not to:

Use the Service for commercial testing, entertainment, or non-educational purposes.
Attempt to disrupt, damage, or gain unauthorised access to the Service.
Misrepresent your identity or your authority to use the Service in an educational setting.

7. Liability and Disclaimers

The Service is provided “as is” and “as available” without warranty of any kind.
To the fullest extent permitted by law, we exclude all warranties, conditions, or representations, whether express or implied.
Mysa Digital will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill.
Our total liability arising out of or relating to these Terms will not exceed £100 or the amount you paid for use of the Service (if any), whichever is greater.

8. Suspension and Termination

We reserve the right to suspend or terminate access to the Service immediately, without notice, if you breach these Terms or if we reasonably believe your use may cause harm to us, participants, or third parties.

9. Changes to the Terms

We may update these Terms from time to time. The latest version will always be available on our website. Continued use of the Service after changes take effect constitutes acceptance of the new Terms.

10. Governing Law

These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
